These Terms of Service ("Terms") govern your use of the website smart.saint-tri.com and the SAINT-TRI Smart subscription service (the "Service"), operated by Saint-Tri GmbH, Höhenweg 15, 9042 Speicher, Appenzell Ausserrhoden, Switzerland, UID CHE-214.924.414 ("Saint-Tri", "we", "us"). By purchasing or using the Service you agree to these Terms.
1. The Service
SAINT-TRI Smart is a self-guided triathlon coaching subscription. It includes structured training plans delivered through the third-party platform Final Surge, a video methodology library, written guides, group Q&A calls and access to an athlete community. The Service is an information and education service. It is not personal supervision, not medical care and not a guarantee of any sporting result (see our Health & Training Disclaimer, which forms part of these Terms).
2. Eligibility
You must be at least 18 years old to purchase the Service. By subscribing you confirm that you are physically able to undertake endurance training or have obtained medical clearance to do so.
3. Subscription, prices and billing
- The Service is sold as an auto-renewing subscription: an introductory period (currently €49 for the first 4 weeks, where offered), followed by €190 per month, or an annual plan of €1,490 per year. Current prices are always shown at checkout.
- Payments are processed by Stripe. Your subscription renews automatically at the end of each billing period until you cancel. Prices include VAT where applicable.
- We may change prices for future billing periods with at least 30 days' notice by email; you may cancel before the change takes effect.
4. Cancellation and refunds
You may cancel at any time with effect from the end of the current billing period. Details, including our 7-day money-back guarantee and the statutory withdrawal rights of EU/UK consumers, are set out in the Refund & Cancellation Policy, which forms part of these Terms.
5. Your account and conduct
You need a free Final Surge account to receive your plans; Final Surge's own terms apply to its platform. Access to the Service is personal and non-transferable. You agree not to share, resell, record, redistribute or publicly post the training plans, videos or written materials.
6. Intellectual property
All content of the Service — training plans, methodology, videos, texts, graphics and trademarks — belongs to Saint-Tri GmbH or its licensors. You receive a personal, non-exclusive, non-transferable licence to use the content for your own training for the duration of your subscription. All other rights are reserved.
7. Community rules
When participating in the community or Q&A calls you agree to behave respectfully and not to post unlawful, offensive or commercial content. We may remove content and, in serious cases, suspend access.
8. Assumption of risk and limitation of liability
Endurance sport carries inherent risks, including injury and, in rare cases, death. You participate voluntarily and at your own risk, as further described in the Disclaimer. To the maximum extent permitted by law, Saint-Tri GmbH is liable only for damage caused by intent or gross negligence; liability for slight negligence, indirect damage and lost profits is excluded. Mandatory statutory liability (including for personal injury where it may not be excluded under applicable law, and mandatory consumer rights in your country of residence) remains unaffected. Our total liability is limited to the amounts you paid for the Service in the 12 months preceding the claim.
9. Availability and changes to the Service
We aim to keep the Service available at all times but do not guarantee uninterrupted availability, in particular of third-party platforms (Final Surge, Stripe, video hosting). We may improve, modify or replace parts of the Service, provided its core value is preserved.
10. Termination by us
We may terminate the subscription with effect from the end of a billing period, or immediately for serious breach of these Terms. In case of immediate termination without your breach, we will refund the unused pro-rata part of prepaid fees.
11. Changes to these Terms
We may update these Terms; material changes will be announced by email or in the Service at least 30 days in advance. If you do not agree, you may cancel before the changes take effect.
12. Governing law and jurisdiction
These Terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is the registered seat of Saint-Tri GmbH (Speicher, Appenzell Ausserrhoden, Switzerland). If you are a consumer habitually resident in the EU/EEA or the UK, mandatory consumer-protection provisions and jurisdiction rules of your country of residence remain unaffected.
